In 1920, in the year that David Henry Halverson was born, the Volstead Act became law. Formally called the National Prohibition Act, the Volstead Act enabled law enforcement agencies to carry out the 18th Amendment. It said that "no person shall manufacture, sell, barter, transport, import, export, deliver, or furnish any intoxicating liquor except as authorized by this act" and defined intoxicating liquor as any beverage containing more than 0.5% alcohol by volume.

In 1925, in the year of David Henry Halverson's passing, in July, the Scopes Trial - often called the Scopes Monkey Trial - took place, prosecuting a substitute teacher for teaching evolution in school. Tennessee had enacted a law that said it was "unlawful to teach human evolution in any state-funded school". William Jennings Bryan headed the prosecution and Clarence Darrow headed the defense. The teacher was found guilty and fined $100. An appeal to the Supreme Court of Tennessee upheld the law but overturned the guilty verdict.
