RYAN v. COUNCIL. In the matter of determination be tween Catherine Ryan and the Council of the Municipality of Dubbo, the Commissioners were asked to deter- mine the amount of compensation to be paid to plaintiff, whose husband, the late John Ryan, died of heart failure while in the employ of the Council. Mr. M. J. Duffy appeared for the plaintiff, and Mr. A. W. Barry, of the Crown Law Office, for the Government insurance Office and the Council. Catherine Ryan gave evidence that she was totally dependent upon the deceased. To Mr. Harry: Witness had one farm. She had previously abandoned one farm in September last, She told Mr. Carters when she abandoned the place. She still had 1500 acres. There were a few horses and cattle on the land. These belonged to her husband. They were the property of witness at the time of her husband's death. Her husband was receiving £13/15/- per fortnight. He had allowed her about £4 per week. Witness had six sons between 23 and 37 years of age. She paid £17 per year rent, and the rates were about £5. To Mr. Duffy: Witness owed £100 to the Lands Department. The land was practically useless. There were about £34 due on it for rates. The. land was liable to forfeiture. Martin Blacket, valuer, stated that the land was not of much use unless a great deal of money was spent on it. The expenditure was not warranted. A number of homestead farms adjoining had been abandoned. In his opinion the land was useless in its present state. Mr. Duffy addressed the Bench, urging that the maximum amount £800 be awarded. The Commission fouud that Catherine Ryan was totally dependent on de- ceased, and awarded her the full amount of £800, payable at the discretion of the Commission.
