In 1925, in the year that Joseph v Fawbush was born, in July, the Scopes Trial - often called the Scopes Monkey Trial - took place, prosecuting a substitute teacher for teaching evolution in school. Tennessee had enacted a law that said it was "unlawful to teach human evolution in any state-funded school". William Jennings Bryan headed the prosecution and Clarence Darrow headed the defense. The teacher was found guilty and fined $100. An appeal to the Supreme Court of Tennessee upheld the law but overturned the guilty verdict.

In 1940, at the age of only 15 years old, Joseph was alive when on September 16th, the Selective Training and Service Act of 1940, was enacted - the first peacetime draft in U.S. history. Men between 21 and 36 were required to register with their draft boards. When World War II began, men between 18 and 45 were subject to service and men up to 65 were required to register.
