In 1919, in the year that Toxie R Dyess was born, in January, Nebraska was the 36th state to ratify the 18th Amendment, making it the law of the land. The 18th Amendment established Prohibition - a law against the production, transport, and sale of alcohol. Private consumption and possession were not prohibited. Several months later, the Volstead Act was passed, creating laws to enforce the Amendment. Bootlegging and bathtub gin followed.

In 1934, at the age of only 15 years old, Toxie was alive when on July 22nd, gangster John Dillinger was killed in Chicago. His gang had robbed banks and police stations, among other charges, and he was being hunted by J. Edgar Hoover, head of the FBI - although many in the public saw him as a "Robin Hood". A madam from a brothel in which he was hiding became an informer for the FBI and, after a shootout with FBI agents, Dillinger was shot and died.
