Henry was a very competent working with dynamite. He was attempting to place dynamite at the top of a fertilizer pile to reduce it's crown. They said that Henry accidentally allowed the electrical circuit to close to the detonate. They said that the charge went off prematurely. His family knowing how competent he was knew that their father would never place the electrical circuit any where near the denotator. Henrys oldest son Lloyd Leivick tried to find the person reasonable for his father death to no avail. Henry's youngest son Earl John Leivick dropped out of school to get hired at the N.S. Koos and Son Company. When Earl got to the site he could see his father's body parts around him. They had not yet gathered the body parts for burial. Richard Koos told the six man jury at the inquest that Henry had been a loyal faithful worker. Richard had full confidence in Henry to set dynamite charges and had worked for them for 10 years. Henry's son Lloyd Leivick was at the hearing and gave testimony about his father. He was one of several men the gave their testimony.
