Anna J. Martin was born Anna Jacoby Theinhardt, biological daughter of Hugo Theinhardt and Anna E. Theinhardt, the later died in 1861. Hugo Theinhardt consented on August 17, 1863 to her adoption by James Martin and Catharine F, Martin.

The facts were as follows: Anna J. Martin dies in Norristown on the 25th of January A. D. 1885, of full age, intestate, unmarried and without issue, and Catharine F. Powel was appointed by register of wills of Montgomery County, administratrix of her estate. Said Anna was the child of Hugo Theinhardt and Anna E. Theinhardt, his wife, the latter died in 1861. In 1863, upon the petition of James Martin and Catharine F. Martin, his wife (now the said Catharine F. Powel, wife of Samuel D. Powel), the Court of Common Pleas of Montgomery County, upon the concurrence of Hugo Theinhardt, allowed the said James martin and Catharine F. Martin, his wife, to adopt the said Anna J. Theinhardt as their child and heir by the following decree: “And now, to wit, August 17, 1863, the consent of Hugo Theinhardt, the father of the child in the foregoing petition mentioned, having been obtained, and the Court being satisfied that the mother of said child is dead, and having said matter under consideration, and being satisfied that the welfare of said child will be promoted by the adoption prayed for in said petition, do now order and decree that said child in said petition mentioned shall assume the name of the adopting parents, the said petitioner, to wit, ‘Anna Jacoby Martin’ and have all the rights of a child and heir of said adopting parents, and be subject to the duties of said child, agreeably to the prayer of said petitioners and the statute in such case made and provided.”
