Heart Attack Fatal to Justice Cardozo, Long Ill; Famed Jurist’s Passing Mourned by Nation July 11, 1938 SEE ORIGINAL DAILY BULLETIN FROM THIS DATE The entire nation mourned today the passing of Justice Benjamin N. Cardozo, America’s leading legal scholar and an associate justice of the United States Supreme Court since 1932, who succumbed last night to a heart attack while recuperating from a long illness at the Port Chester estate of judge Irving Lehman. He was 68 years old on May 24. “The news of the passing of Justice Cardozo,” Mr. Roosevelt said in a statement issued in Oklahoma City, where he is on a political tour, “came to me as a great personal shock. Years ago, when he was Chief Justice of the high court of New York, I learned to admire and love him. He had a great soul. The whole nation has lost a constant friend.” Others who paid tribute included Governor Herbert H. Lehman, associate justices on the Supreme Court, cabinet members, senators, and leaders of Jewish organizations. Present at his bedside when he died were Judge Lehman and Justice Cardozo’s secretary, Joseph Rauh. The jurist, conscious to the last, passed away quietly, without speaking. Funeral services are scheduled for two o’clock Monday afternoon at the Lehman estate, with the Rev. D.A. Jessurun Cardozo, assistant minister of the Congregation Shearith Israel of New York, officiating. Rabbi Cardozo is not related to the jurist. Burial will be in Queens.
