In 1911, in the year that Ernst Washington was born, the United States Supreme Court broke up Standard Oil in May. John D. Rockefeller established Standard Oil in 1870 and it was the largest oil refinery at the time. The Supreme Court found that Standard Oil of New Jersey (one of the many iterations of Standard Oil) was guilty of "monopolizing the petroleum industry through a series of abusive and anticompetitive actions". The Court broke up the several entities that comprised Standard Oil and they eventually became competing firms.

In 1925, at the age of just 14 years old, Ernst was alive when in July, the Scopes Trial - often called the Scopes Monkey Trial - took place, prosecuting a substitute teacher for teaching evolution in school. Tennessee had enacted a law that said it was "unlawful to teach human evolution in any state-funded school". William Jennings Bryan headed the prosecution and Clarence Darrow headed the defense. The teacher was found guilty and fined $100. An appeal to the Supreme Court of Tennessee upheld the law but overturned the guilty verdict.
