He married Catherine Mcdonald Summerhayes, and had children John Simon Summerhayes, May Elizabeth Summerhayes, Christina Summerhayes, Ivy Summerhayes, Charles Summerhayes, Percival Summerhayes, Amy Summerhayes, Elsie Summerhayes, and Norman Summerhayes. James Summerhayes died at age 67 years old on September 26, 1939 in Banyena, Northern Grampians Shire County.

In 1872, in the year that James Walter Summerhayes was born, on May 22nd, President Ulysses S. Grant signed the Amnesty Act of 1872. The Act restored full civil rights to secessionists, including about 150,000 former slaves who had fought in the Confederate Army. About 500 former Confederate sympathizers were not allowed their full civil rights.
