John Watmuff's first wife (unknown name) died on March 28th, 1803. 001 This is the last Will and Testament 002 of me John Watmuff of Princes Street Leicester Gentleman made this 003 Twenty fourth day of April in the year of our Lord one thousand eight 004 hundred and forty five in manner following that is to say ffirst I here 005 by nominate constitute and appoint my Son Henry Watmuff of No 26* 006 Beresford Terrace Kensington Street Walworth London and my other Son 007 Joseph Watmuff of Leicester Draper Trustees and Executors of this my 008 will I do hereby devise will and bequeath unto my two said Sons Henry 009 Watmuff and Joseph Watmuff all that my freehold estate situate lying 010 and being in Toft in the Parish of Wytham on the Hill in the ''' 011 County of Lincoln and containing by estimation sixty two acres more 012 or less now in the tenure and occupation of Edis Smith of Thurlby 013 in the said County of Lincoln Innkeeper at the yearly rent of one 014 hundred and five pounds sterling all which said freehold estate I ''' 015 hereby will and direct shall be equally divided between my said two 016 sons Henry Watmuff and Joseph Watmuff by my said Trustees in ''' 017 equal shares thereof and the annual rent shall be equally divided " 018 unto and between them yearly and every year amounting to fifty 019 two pounds and ten shillings to each of them but should my said Son " 020 Henry Watmuff be inclined to dispose of his part or share of the said " 021 estate he may by way of virtue of this my will in disposing or selling his " 022 part of the said estate he may by virtue of this my will to his Brother 023 Joseph Watmuff for one thousand pounds and no more. And if my '' 024 said Son Joseph Watmuff should be inclined to dispose of his part or ''' 025 share of the said the said estate he may by virtue of this my will to his "" 026 Brother Henry Watmuff for one thousand pounds and no more but " 027 should my said Sons not feel inclined to dispose of either of their " 028 share to the other of them then in that case I hereby will and " P2 029 direct that they both hold the said freehold estate between them and in 030 equal part and portion Thereof as aforesaid as my will is that I ''' 031 desire the Land and Estate is not to be parted other ways than above 032 named/excepting the trees if they agree to cut any or all down '' 033 that the value of them when sold or disposed of such sum or sums '' 034 shall be equally divided unto and between them share and share 035 alike I give devise and bequeath unto my Daughter Sarah Watmuff 036 All that my messuage or tenement I now live in And all my house-* 037 hold furniture I may be possessed of at the time of my decease, the 038 books and silver excepted I further give devise and bequeath unto 039 my said Daughter Sarah Watmuff the sum of five hundred "" 040 pounds sterling and her piano forte I give devise and bequeath ''' 041 unto my Son Stephen Watmuff the sum of three hundred pounds 042 now residing at Halifax in Yorkshire I give and bequeath unto " 043 my Son Frederick Watmuff the sum of eight hundred pounds I give and 044 bequeath unto my Son John Thomas Watmuff the sum of five ''' 045 hundred pounds and the messuage or tenement I lately purchased 046 at Leicester adjoining the one I now occupy myself And my further 047 will is that my trustees and Executors do pay the aforesaid legatees 048 above named their respective legacies at my decease or as soon after 049 as convenient excepting to my Son Frederick Watmuff who is from " 050 home that when he returns home and is unsteady he is not to '' 051 be paid his legacy but only the interest thereof until he becomes 052 steady and puts himself in any business or capacity for a future 053 livelihood then my said Trustees and Executors may then pay him 054 his full legacy and not otherwise And I further will and direct that 055 my Trustees and Executors do not pay my Son John Thomas Watmuff 056 His legacy at my death if he is unsteady and have not put himself 057 in any way of business or capacity to maintain and provide for '' 058 himself they are only to pay him the interest thereof until He 059 turns steady and provides a respectable livelihood for himself Then '' 060 my trustees may then pay him his legacy hereinbefore bequeathed 061 him and not otherwise And the mortgages that I may hold at my 062 decease to give them proper notices to pay the same to all my Trustees ' 063 and Executors whereby they may pay the respective legacies herein 064 by me given my sons Frederick Watmuff and John Thomas Watmuff 065 excepted as above quoted But that all the other legacies the above 066 two excepted shall be paid from and out of such monies mortgages 067 Bonds Bank shares and personal Estates that I may be possessed of 068 at the time of my decease and all Residue and Remainder thereof 069 I will and direct shall be distributed unto my said sons and Daugh- 070 ter Henry Watmuff Joseph Watmuff Stephen Watmuff Frederick " 071 Watmuff John Thomas Watmuff and Sarah Watmuff in equal " 072 shares and portion thereof but should any of my said Sons or '' ''' 073 Daughter die without leaving lawful issue or issues thereof I then 074 hereby give and bequeath the legacy and share or legacies and ''' 075 shares of him her or them so dying unto the survivors of them ''' 076 respectively but should any of my said Sons or Daughter die and '' 077 leaving lawful issue I hereby direct that such legacy or legacies ''' 078 share or shares of them or her so dying shall go unto the lawful 079 issue or issues of him her or them so dying and not otherwise I give 080 and bequeath unto my Nephew John Watmuff of Bourn Lincoln- 081 Shire all my copyhold close or pasture land held of the Manor of '' 082 Bourn Abbots in Bourn South Fen containing by admeasure- 083 ment 2 acres 1 rood and 21 perches formerly Thorolds @ Shilcock of ''' 084 Scalford County of Lincoln purchased by me 1799* on 17Apl. paid " 085 *Drec.
