The uniform is US Army. (he has round disks on lapel - tells what job field he is in). Marines would have white cap and overall a more fancy looking uniform.
It appears to be army. I would guess World War II. I was in the U.S. Navy in the 70's and regular enlisted were assigned from time to time to do temporary duty in Shore Patrol, which is the Navy's version of MP's. He may have been on temporary assignment. He has no rank or other insignia except for the medal on his pocket which I can't make out. This would indicate to me that he had not been in the military very long when this was taken.
