A man prosecutors called "the personification of evil" after he was convicted of the kidnapping, sex assault and killing of a 10-year-old in 1976 was denied another appeal Tuesday in the decades-old case. Anthony “Lee” Foskey, who later changed his name to Jamal Waliyuallah, had sought to have his sentence reconsidered on the grounds he received ineffective council. A Superior Court judge denied the request and the Appellate Court ruling issued Tuesday affirmed that ruling. Waliyuallah confessed in 1995 to sexually assaulting and killing Jon “Vernie” Mitchell nearly two decades earlier. He was convicted and sentenced to prison in 1999. Waliyuallah, 57, previously appealed his conviction to the state Supreme Court, which declined to hear the case. He has since been pursuing additional appeals through post-conviction relief hearings. Mitchell left his Trenton home at 8 p.m. on Jan. 28, 1976, to buy bread for his mother from a neighborhood market and never returned. The 10-year-old's body was later found mutilated with more than 80 cuts and stab wounds, according to prosecutors. Police interviewed Waliyuallah multiple times over several years as a suspect in the case before he failed a polygraph test and later confessed. "Vernie" Mitchell, born Jon Mitchell, was the son of Shirley Mitchell (1948 - 1994). His headstone reads: "Jon "Vernie" Mitchell 1965 - 1976 Love, Mom & Dad Sisters & Bros." Ten year old Vernie left home at 8 pm on January 28th 1976 to buy bread from a neighborhood store. His body was later found "mutilated with more than 80 cuts and stab wounds". He had been kidnapped, raped, and murdered.
